Introduction

ValueXI is a customizable low-code platform designed for processing of structured data, built on the technologies of artificial intelligence and machine learning. It analyzes and categorizes data your company is getting via website, email, messengers, contact forms and any other channels.

This Privacy Policy (“Policy”) governs how we collect, use, share, and otherwise process your personal information when you visit this website www.valuexi.com (“Website”) or when you use the ValueXI system and related services. The Policy also explains your rights and choices regarding our use of your information.

Please read this Privacy Policy carefully before you submit your personal information to us or through ValuXI. By accessing and using the Website, ValueXI and related services, you agree to this Policy. If you do not agree to this Policy, do not use this Website and the ValueXI system.

Who we are

ValueXI is a product of WaveAccess, a transnational IT company that provides software development services. While implementing AI and ML for our enterprise customers, we have accumulated a critical mass of expertise in the field. This is how ValueXI was born.

We respect and protect your privacy and personal data. We collect the minimal amount of information necessary to provide you with products and services you requested. We are committed to following the principles outlined in the EU’s General Data Protection Regulation (the “GDPR”) and other applicable privacy laws. 

Main definitions

When we talk about “personal information” or “personal data”, we mean any information relating to an identified or identifiable natural living person (“data subject”).

Some data protection laws and privacy laws differentiate between “controllers” and “processors” of personal information. A controller determines the purposes and means (the why and how) of the processing of personal data. A processor does not make decisions, but only processes personal information on behalf of a controller based on the controller’s instructions. With this in mind, when you use our Website and ValueXI and related services, we process personal information in different ways.

Customer Account Data

When you are a user or a potential user of the ValueXI system — we process your personal information (e.g., your contact information) — when you visit our Website; sign up for a demo; use ValueXI and related services; contact our sales or support teams; and communicate with us directly. When we process your Customer Account Data, WaveAccess is acting as the controller.

Customer Content Data

When you are a customer and use the ValueXI system — you upload your datasets to train the machine learning system, and these datasets may or may not contain personal information of data subjects. WaveAccess does not have access to and does not process Customer Content Data, unless instructed by Customer. When you process your Customer Content Data, you are acting as either a controller or a processor.

How Customer Content Data is processed

The ValueXI system is installed on-premises. WaveAccess provides customers with installation instructions and technical support during deployment. Customer uploads labeled datasets to train the AI model. All data is stored on customer’s servers, and WaveAccess does not have access to and does not process the data, unless instructed by Customer. Customer’s instructions should be documented separately.

The particular personal data which you upload to the ValueXI system as a part of a dataset, depends on how you, as our customer, decide to use ValueXI. Within the system we also offer you the ability to delete, access, or exercise other choices about Customer Content Data.

Note that prior to uploading this data to ValueXI, it is your responsibility as the controller or processor of Customer Content Data to comply with applicable data protection laws in its use of ValueXI and related services.

Whose personal information we collect

We collect personal data about visitors to this Website and users of ValueXI and related services, including current and potential customers, suppliers, and partners.

This Website and Software are not intended for children (under the age of 13 in the US, or under the age of 16 if you live in the EEA) and we do not knowingly collect data relating to children. If we become aware that a child has provided us with personal data, we will take appropriate steps to delete such data. Under no circumstances do we collect or process special categories of personal data (sensitive data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data) about you via this Website.

We collect the minimal amount of information necessary to provide services to you. We collect information about you when you provide it to us, when you use our Website, the ValueXI system and related services.

Information you share directly

We only collect personal data which you provide voluntarily. You agree to provide true, accurate and complete information. You are not required to provide us with any of your personal data, but in this case, you may not be able to use ValueXI and related services, use certain features of the Website, participate in events, or receive marketing communications.

When you contact us through the Website

When you fill out contact forms of the Website to send an inquiry or request a demo, we may ask you to provide your Name and Email Address.

When you purchase ValueXI and services

When you become our customer, including when you install or purchase ValueXI and related services, we may ask you to provide your First Name, Last Name, Email Address, Company Name, Billing and Shipping Address, Phone Number, and Payment Details. 

When you request support

When you send us a technical support request, we may ask you to provide your First Name, Last Name, Email Address and other information relating to your issue.

When you subscribe to marketing communications

When you subscribe to marketing newsletters to receive information about ValueXI updates, special offers, news or other communications, we may ask you to provide your Name and Email Address.

When we communicate directly

When we communicate directly, by email, phone or other means of communication, we may also obtain additional information you choose to provide. For example, a screenshot of an error during a technical support session, or your testimonial during a user interview.

Information we collect automatically

When you access and use the Website, we may automatically obtain information about how you interact with it. We use this information to analyze how people use our Website and improve your user experience.

When you use the Website

The information we collect includes the pages you visit; URL clickstream to, through and from the Website, including date and time; errors; actions you take on the Website; information about your browser, operating system, internet service provider; location data and time zone through IP address, and other technical information.

When you use the ValueXI system and related services, we may use your personal data to provide you access to ValueXI functionality.

When you become our customer, including when you install or purchase ValueXI and related services, we may use your data to process your orders and send you product order-related information.

When you send us a technical support request, we may use your data to receive, respond to, follow up and otherwise communicate with you about your support issues, as well as use it for further ValueXI development.

We require all third parties to respect the security of personal data and provide reasonable assurances that they will appropriately safeguard the personal information.

How to make choices about your personal information

When you provide us with your personal data, you have certain rights to make choices regarding your personal information.

Right to request access

You may request details of personal data which we have about you, information about the legal basis and purposes for processing this data, how we have obtained it, who we may share it with, how long we retain it and other information about the processing of your personal data for the period of twelve (12) months prior to the request.

Right to request rectification

Note: this right only applies to your personal data which you originally provided consent for us to use, or where we used your personal data to perform a contract with you.

Note: this will not affect processing that has already taken place. If you withdraw your consent, you may not be able to use the ValueXI and related services, certain features of the Website, participate in events, or receive marketing communications.

Note: we may still send you non-promotional messages relating to updates of our terms of service or privacy policies, and other notices relating to your access to or use of ValueXI and related services.

International data transfers

The internet is a global environment and our customers and service providers are located in many countries around the world, so international data transfers may be necessary to provide you with the Website, ValueXI and related services.

Your Customer Account Data may be transferred outside the country where you reside or are located to the United States or another country, where we, our affiliates, contractors, or our third-party service providers operate. WaveAccess employs appropriate safeguards for cross-border transfers of personal information, as required by applicable law.

You consent to the transfer of all such information internationally, including to the United States, which may not offer the same level of protection as your country requires, and consent to the processing of that information by us and our trusted third-party service providers internationally as described in this Policy.

If you do not want your Customer Account Data transferred or processed outside of your country, please do not submit your information to us.

Customer Content Data that you upload to ValueXI is not transferred internationally and remains on your servers.

How we protect your data

While we take every step to protect your information, please note that no system can be 100% secure.

We take all appropriate legal, technical and organizational measures to protect personal data from unauthorized access, use, disclosure, copying, modification or destruction, and from unintentional loss, misuse and alteration. These measures vary based on the sensitivity of the information that we collect, process and store and the current state of technology.

We use a variety of secure techniques, including SSL protocol to encrypt the information sent through the Website, secure servers, firewalls, antivirus programs, authorization methods, intrusion detection systems, and system penetration testing. Only authorized personnel can access your data.

When you navigate our Website or when you interact with emails we sent to you, we may use common information-gathering tools such as cookies, web beacons, pixels and other similar tracking technologies to automatically collect information.
